Creator Agreement

Draft — requires professional legal review
1. Scope
This Creator Agreement applies to everyone who submits, lists, or promotes a project on BackerCove. It supplements, and is part of, our Terms of Service. By submitting a project or purchasing a creator service, you agree to this Agreement.
2. Accuracy & permissions
You represent that all information you submit — including campaign descriptions, funding figures, timelines, rewards, imagery, and links — is accurate, current, and not misleading, and that you will keep it up to date. You represent that you are authorized to submit the project and that it corresponds to a genuine crowdfunding campaign. You are responsible for any claims you make about your product, its status, or its delivery.
3. License to display your materials
You retain ownership of the materials you submit. You grant BackerCove a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt for formatting, display, publish, and promote those materials on and through the Service and our marketing and community channels (including Discord, email, and social posts) to operate and promote the Service and your listing. You represent that you hold all rights needed to grant this license and that your materials do not infringe any third party's rights. The license ends when your listing or account is removed, except for materials already distributed, retained in backups for a limited period, or required to be kept by law.
4. No guarantee of funding, backers, or success
BackerCove does not guarantee that your campaign will be funded, reach any particular number of backers or pledge amount, receive media coverage, or succeed. Listing, curation, badges, Community Boost packages, and consultations provide discovery, promotion, and guidance only. Nothing we provide is investment, financial, or legal advice, and no statement by us or on the Service should be treated as a promise of any outcome.
5. Community Boost & consultation terms
Community Boost packages deliver defined promotional effort and placement — such as directory listing, featured placement, community announcements, email features, and social promotion — as described for each tier at checkout. They are measured by the delivery of that promotional effort, not by campaign results. We track each deliverable's status in your studio.
The free introductory consultation and the paid Campaign Strategy Session provide general strategic guidance (such as page feedback, reward-structure ideas, and launch planning). They are not a guarantee of results and are not investment, financial, or legal advice. You remain solely responsible for decisions about your campaign. Where a “Funded-or-Free” or similar arrangement is offered, its conditions are stated on the offer and at checkout and operate only as a billing/refund term — not a success guarantee.
6. Fulfillment & backer relationships
You are solely responsible for your campaign and for fulfilling any rewards or obligations to your backers, including production, shipping, refunds on the external platform, communications, and compliance with the external platform's rules and applicable law. BackerCove is not a party to your campaign, does not collect pledges, and has no responsibility for fulfillment. Disputes with backers are between you and them under the external platform's terms.
7. Prohibited campaigns
You may not submit campaigns that are unlawful, fraudulent, deceptive, or infringing, or that fall within prohibited categories under our Acceptable Use Policy and eligibility rules (for example, illegal goods or services, weapons or regulated items where restricted, hateful or exploitative content, or misrepresented projects). We may decline or remove any submission that does not meet our standards.
8. Review, takedown & removal
Submissions are reviewed before publication and may be approved, returned for changes, or rejected. We may unpublish, edit for formatting, or remove a listing at any time if it violates our policies or the law, if information proves inaccurate, or to protect the Service or its users. For a project with an active paid Boost, we will handle affected deliverables consistent with our Refund Policy. You may remove your own listing at any time, subject to the fee and refund terms below.
9. Fees & refunds
Fees for paid creator services are shown at checkout and processed via Stripe. Refunds are governed by our Refund Policy. If we remove a listing for a policy or legal violation caused by you, fees for promotional effort already delivered are non-refundable except as that policy or applicable law requires.
